This website is operated by Good Chemistry Limited trading as Loveskin (“Loveskin”, “we”, “us” or “our”).

These Terms & Conditions apply to your use of our website, online store, social media pages, email communications, customer accounts, subscriptions and any other online services we provide.

By accessing our website, placing an order, creating an account, subscribing to products, or otherwise using our services, you agree to these Terms & Conditions. Please read them carefully before purchasing from us.

Nothing in these Terms limits or excludes any rights you may have under the Consumer Guarantees Act 1993, Fair Trading Act 1986, Privacy Act 2020, or any other applicable New Zealand law that cannot legally be excluded.


1. About Loveskin

Loveskin is a New Zealand skincare brand. We make and sell cosmetic skincare products for personal use.

Our products are available through our website and may also be available through selected stockists, partners or other sales channels.

2. Online store terms

You must be legally able to enter into a contract to place an order through our website. If you are under 18, you should only use our website or purchase from us with the involvement of a parent or guardian.

You agree not to use our website, products or services for any unlawful or unauthorised purpose. You must not transmit viruses, malicious code, worms or any code of a destructive nature.

We reserve the right to refuse service, cancel orders, suspend accounts or restrict access to our website where we reasonably believe there has been misuse, fraud, unlawful activity, abuse of our team, breach of these Terms, or any other conduct that may harm Loveskin, our customers or our services.


3. Skincare and cosmetic product information

Loveskin products are cosmetic skincare products intended to support the appearance, feel and condition of the skin. They are not medicines and are not intended to diagnose, treat, cure or prevent any disease, medical condition or skin disorder.

Information on our website, product pages, packaging, emails, social media, blog posts, guides and other content is provided for general skincare education only. It is not medical advice and should not be relied on as a substitute for advice from a qualified health professional.

If you have a skin condition, allergy, active irritation, infection, broken or compromised skin, are under medical treatment, are pregnant or breastfeeding, or are unsure whether a product is suitable for you, please seek advice from a qualified health professional before use.


4. Allergies, patch testing and individual results

Everyone’s skin is different. Results vary from person to person and may depend on your skin type, skin condition, routine, environment, health, age, hormones, product use and other individual factors.

We recommend patch testing new products before first use, particularly if you have sensitive, reactive, allergy-prone or compromised skin.

To patch test, apply a small amount of product to a discreet area of skin and wait at least 24 hours before applying more broadly. Discontinue use if irritation occurs.

Our products may contain botanical oils, essential oils, nut oils, seed oils, plant extracts, naturally occurring fragrance compounds and other cosmetic ingredients that may not be suitable for everyone. Please read the full ingredient list before purchase and use.

Customer reviews, before-and-after images, testimonials, routines, product recommendations and skincare guidance describe general or individual experiences only. They do not guarantee that you will experience the same result.


5. Natural variation

Our products may contain natural botanical ingredients and may be made in small batches. As a result, there may be natural variation in colour, aroma, texture, viscosity or the appearance of fine sediment.

This natural variation does not usually affect product quality or safety when the product is used as directed and within its recommended shelf life.

If you are concerned that a product may be faulty, contaminated or significantly different from what you expected, please contact us before continuing use.


6. Product care, storage and use

Please use Loveskin products only as directed.

Unless otherwise stated, our products are for external cosmetic use only. Avoid direct contact with eyes. Keep products out of reach of children and pets.

Store products away from direct sunlight, excessive heat, moisture and humidity. Keep lids and caps closed securely when not in use.

Do not use a product if it appears contaminated, smells unusual, has changed significantly in appearance, or has passed any applicable expiry, best-before or period-after-opening guidance.

We are not responsible for product deterioration caused by incorrect storage, misuse, contamination after opening, or use outside our directions.


7. Product descriptions, availability and pricing

We aim to describe and display our products as accurately as possible. However, product colours, packaging, textures and imagery may appear differently depending on your device, screen settings or lighting.

Product descriptions, ingredients, pricing, promotions and availability may change from time to time without notice.

We reserve the right to limit quantities, discontinue products, update formulations, change packaging, cancel products, or refuse orders where necessary.

If we make a material change to a product you have ordered before dispatch, we will take reasonable steps to contact you.


8. Orders and billing information

When you place an order, you agree to provide current, complete and accurate billing, shipping and contact information.

We may refuse, limit or cancel an order where we believe the order is fraudulent, incorrect, in breach of these Terms, placed by a reseller without approval, affected by a pricing or stock error, or otherwise inappropriate for fulfilment.

If we cancel or change an order, we will take reasonable steps to contact you using the email address, phone number or billing details provided at the time of purchase.

You are responsible for ensuring your shipping address and contact details are correct. We are not responsible for delays, failed delivery or additional costs caused by incorrect or incomplete information supplied by you.


9. Payment

Payment must be made using one of the payment methods available at checkout.

By providing payment details, you confirm that you are authorised to use that payment method.

Orders will not usually be dispatched until payment has been received or authorised.

If a payment is declined, reversed, disputed or otherwise not received, we may delay fulfilment, cancel the order, suspend your account, or recover any outstanding amount owed.


10. Subscriptions

If you purchase a subscription, you authorise us and our payment provider to charge your selected payment method on a recurring basis at the frequency selected at checkout or in your customer account.

Subscription pricing, product availability, shipping costs and product options may change from time to time. Where practical, we will take reasonable steps to notify you of material changes.

Subscriptions are intended for regular, ongoing product supply. They are not intended to be paused indefinitely or used only to access a subscription discount.

Unless otherwise stated at the time of purchase, subscription customers must complete the minimum subscription term or minimum number of recurring orders shown at checkout before cancelling, if a minimum term exists.

You may manage your subscription through your customer account or by contacting us.

Subscription pauses

You may pause a subscription where the option is available. However, a subscription may not be placed on pause for more than six months in total, whether as one long pause or multiple shorter pauses, unless we agree otherwise in writing.

If a subscription remains paused for more than six months, or if repeated pauses mean the subscription is no longer operating as a genuine recurring subscription, we may cancel the subscription.

Our right to cancel subscriptions

We reserve the right to cancel, suspend or decline to renew a subscription at any time, including where:

  • a product is discontinued or unavailable;

  • payment fails repeatedly;

  • shipping details are invalid or incomplete;

  • the subscription has been paused for more than six months;

  • the subscription is being used in a way that is inconsistent with the purpose of a recurring subscription;

  • we reasonably suspect misuse, fraud or abuse of a subscription offer;

  • continuing the subscription is no longer commercially or operationally practical for us.

If we cancel a subscription, you will not be charged for future recurring orders under that subscription. Any orders already processed or dispatched will be handled in accordance with our usual order, shipping and returns terms.


11. Shipping and delivery

Delivery timeframes are estimates only. We will use reasonable care to dispatch orders promptly, but we are not responsible for delays outside our reasonable control, including postal delays, courier disruption, customs delays, weather events, public holidays, incorrect addresses or events beyond our control.

Shipping charges, delivery options and estimated timeframes will be shown at checkout where applicable.

If an order is returned to us because of an incorrect address, failure to collect, refusal of delivery, or other issue not caused by us, additional shipping charges may apply to resend the order.

For international orders, you are responsible for any customs duties, import taxes, local charges or restrictions that may apply in your country.


12. Returns, refunds and consumer guarantees

Nothing in these Terms or our Shipping, Refunds & Returns Policy limits or excludes any rights you may have under the Consumer Guarantees Act 1993, Fair Trading Act 1986, or any other applicable New Zealand law.

Because skincare products are personal-use items, we may not accept returns for change of mind where a product has been opened, used or handled in a way that makes resale unsuitable, unless required by law.


13. Promotions, discounts and gifts with purchase

Promotional offers, discount codes and gifts with purchase are valid only for the period stated and while stocks last.

Offers may exclude subscriptions, bundles, gift cards, sale items, limited edition products or other products as stated.

Unless expressly stated, discount codes cannot be combined with other offers.

Gifts with purchase are not redeemable for cash and cannot usually be exchanged or returned separately. If a gift becomes unavailable, we may substitute it with another item of similar value or end the offer early.

If you return items from an order that qualified for a gift with purchase, we may require the gift to be returned unused, or we may deduct the value of the gift from any refund, where permitted by law.

We reserve the right to cancel, amend or withdraw a promotion where there has been an error, misuse, fraud, technical issue, stock issue or other circumstance that reasonably requires us to do so.


14. Gift cards

Gift cards, where available, are issued subject to the terms shown at the time of purchase.

Gift cards are not redeemable for cash and cannot be returned or refunded except where required by law.

Please treat gift cards like cash. We are not responsible for lost, stolen or misused gift cards unless required by law.


15. Reviews, comments, feedback and user content

If you submit a review, comment, photo, testimonial, feedback, idea, suggestion or other content to us, you agree that we may use, reproduce, edit, publish, display and share that content for our business purposes, including on our website, product pages, emails, advertising and social media, unless you tell us otherwise.

You must not submit content that is false, misleading, unlawful, offensive, defamatory, abusive, obscene, discriminatory, infringes another person’s rights, contains personal information about someone else without permission, or contains viruses or malicious code.

We may moderate, edit, decline or remove user content at our discretion.

You are responsible for the accuracy of any content you submit.


16. Intellectual property

All content on our website and online channels, including our name, logo, product names, product descriptions, images, graphics, text, design, layout, icons, videos, trademarks and other materials, is owned by or licensed to Loveskin.

You must not copy, reproduce, sell, resell, modify, distribute, exploit or use our content without our prior written permission.

You may share our publicly available content for personal, non-commercial purposes provided you credit Loveskin and do not alter the content or present it in a misleading way.


17. Third-party tools, links and services

Our website may include links to third-party websites, tools, apps, payment providers, review platforms, social media platforms, shipping providers or other services that are not owned or controlled by us.

We are not responsible for the content, accuracy, availability, privacy practices, policies or actions of third-party websites or services.

Your use of third-party services may be subject to their own terms and policies. Please review those terms before using them.


18. Privacy

Your personal information is handled in accordance with our Privacy Policy.

By using our website, placing an order, creating an account, joining our email list, leaving a review or using our services, you acknowledge that we may collect, use and disclose personal information as described in our Privacy Policy.


19. Prohibited uses

You must not use our website, content, products or services:

  • for any unlawful purpose;

  • to breach any applicable law or regulation;

  • to infringe our intellectual property rights or the rights of others;

  • to submit false, misleading or fraudulent information;

  • to harass, abuse, insult, harm, defame, threaten, intimidate or discriminate against others;

  • to upload or transmit viruses, malware or malicious code;

  • to collect, track or misuse the personal information of others;

  • to spam, phish, scrape, crawl, hack or interfere with our website or systems;

  • to bypass security features or access controls;

  • to resell our products without written permission;

  • for any purpose that may harm Loveskin, our customers, our suppliers or our services.

We may terminate or restrict your access to our website or services if you breach these Terms.


20. Errors, inaccuracies and omissions

Occasionally there may be errors, inaccuracies or omissions on our website or in our communications, including in relation to product descriptions, ingredients, pricing, promotions, offers, shipping charges, delivery times or availability.

We reserve the right to correct errors, update information, cancel orders, or change or update content at any time, including after an order has been submitted, where permitted by law.

We are not required to update, amend or clarify information except as required by law.


21. Limitation of liability

To the maximum extent permitted by law, and subject to any non-excludable rights you have under New Zealand consumer law, Loveskin will not be liable for any indirect, incidental, special, consequential or punitive loss or damage, including loss of profits, revenue, savings, data, goodwill or business opportunity.

Our products and services are provided for personal cosmetic use. You are responsible for using products as directed, checking ingredients before use, patch testing where appropriate, and seeking professional advice where needed.

Nothing in these Terms limits or excludes our liability where it would be unlawful to do so.


22. Indemnity

You agree to indemnify and hold harmless Loveskin, Good Chemistry Limited, our directors, employees, contractors, suppliers, service providers and partners from any claim, demand, loss, liability or expense arising from your breach of these Terms, your misuse of our website or products, your violation of any law, or your infringement of the rights of another person.


23. Events outside our control

We will not be responsible for delays or failure to perform our obligations where caused by events outside our reasonable control, including natural disasters, severe weather, courier or postal disruption, supply chain delays, labour disruption, government action, technical outages, cyber incidents, public health events or other circumstances beyond our control.


24. Termination

These Terms apply unless and until terminated by either you or us.

You may stop using our website and services at any time.

We may suspend or terminate your access to our website, account, subscription or services where we reasonably believe you have breached these Terms, misused our services, failed to pay amounts owing, acted fraudulently, or engaged in conduct that may harm Loveskin, our customers or our team.

Any obligations or liabilities incurred before termination will continue after termination where relevant.


25. Severability

If any part of these Terms is found to be unlawful, void or unenforceable, that part will be treated as severed to the extent necessary, and the remaining provisions will continue in full force and effect.


26. Entire agreement

These Terms, together with any policies or terms referenced on our website, form the entire agreement between you and us in relation to your use of our website, products and services.

Our failure to exercise or enforce any right under these Terms does not constitute a waiver of that right.

 

27. Governing law

These Terms are governed by the laws of New Zealand.

Any dispute relating to these Terms, our website, products or services will be subject to the laws and courts of New Zealand, unless applicable consumer law provides otherwise.

 

28. Changes to these Terms

We may update, change or replace any part of these Terms from time to time by posting the updated version on our website.

The version published on our website at the time you use the website or place an order will apply to that use or order.

Your continued use of our website or services after changes are posted means you accept the updated Terms.
